Rental Agreement

RENTAL CONTRACT TERMS & CONDITIONS BY SIGNING THIS CONTRACT YOU AGREE TO THE TERMS & CONDITIONS STATED IN THIS SECTION. This is a contract. This contract contains important terms and conditions including lessor’s disclaimer from the liability for injury or damage and details of customer’s obligations. These terms and conditions are a part of this contract. READ THEM! If equipment does not function properly notify lessor within 30 minutes of occurrence or no refund or allowance will be made. If this is a reservation a reservation cancellation fee up to ½ of the total amount may be charged if reservation is cancelled within 72 hours of the scheduled “time and date out”. I certify that I have read and agree to all terms of this contract. RENTAL CONTRACT – TERMS AND CONDITIONS (1) The rental equipment has been received in good working condition and will be returned in the same condition ordinary wear and tear accepted. (2) Customer assumes all responsibility for injuries to persons or damage to property and agrees to hold lessor harmless for any and all claims of whatsoever nature arising out of use of the rental of the equipment while in his custody. (3) Customer agrees to lessor’s rights to enter premises of customer at any time to repossess said equipment. Customer hereby waives any rights of action against owner by reason of such taking or entry and agrees to reimburse lessor’s cost of repossession, if any. (4) Customer agrees to reimburse lessor for all attorney fees an amount not less than 25% of all sums due, court cost and expenses incurred by lessor to enforce collection or to preserve or enforce lessor’s rights under this contract. (5) Customer agrees not to loan, sublet or otherwise dispose of equipment or use it at any other location than listed on the face of the contract. (6) PAYMENT: a. Customer agrees to pay lessor upon demand: I. All Rates, charges, taxes, fuel, delivery, pickup and reservation cancellation fees and all other amounts incurred as a result of this rental transaction. ii.Replacement cost for any loss or disappearance of equipment due to theft, conversion or other dishonest acts on any person or persons to whom the issued property is entrusted or any person or persons in the service or employment of the lessee whether or not occurring during the hours of such service or employment. Lessor reserves the right to consider the property lost, stolen or converted if not returned with TEN DAYS of the date and time printed under the “TIME AND DATE DUE IN” column on the contract. b. Credit Card – Customer authorizes that lessor may bill customer’s credit card at time of reservation or upon receipt of the rented item(s) or upon the return of the item(s). Customer agrees to pay a 3% transaction fee on the total amount of charge, if amount charged is over $1000.00. c. Final Audit – CUSTOMER UNDERSTANDS THAT ALL CHARGES ARE SUBJECT TO FINAL AUDIT. Customer authorizes any credits or additional charges to be made and paid by the method used at the time of the reservation, rental or return. (7) Customer agrees to pay in full replacement cost, including labor, for all damages to rental equipment due to any cause whatsoever. (8) Unless waived by customers initials next to damage waiver charge on this contract, customer agrees to pay a damage waiver fee which is a percentage of the rental fee. In exchange for this fee lessor agrees to modify paragraph 7 (above) of this contract and relieve customer of liability for accidental damage to the rental item(s) on the contract and for loss due to collision, windstorm, upset and riot. However, excluded from this waiver is any loss or damage due to theft, burglary, theft by conversion, mysterious disappearance, misuse or abuse, intentional damage, damage incurred transporting the rented item(s) on public or private roadway or any loss due to customer failing to care for the rented item(s) as a prudent man would his own property, such as proper lubrication. If the customer has insurance the DAMAGE WAIVER becomes secondary. (9) THERE ARE NO WARRANTIES OF MERCHANTABILITY OR FITNESS EITHER EXPRESSED OR IMPLIED WHICH EXTEND BEYOND THE DESCRIPTIONS OF THE FACE HEREOF. (10) RENTAL FEES ARE FOR PORTAL TO PORTAL TIME OUT, NOT TIME USED, INCLUDING ANY PERIOD LESSOR IS CLOSED. OVERDUE RATES FRO EQUIPMENT RENTALS ARE COMPUTED @1/16 THE DAILY RATE FOR EACH HOUR OVER A DAY (24 HOURS). A ONE DAY RENTAL RATE FOR EQUIPMENT WITH RUN TIME HOUR METER CONSISTS OF 10 HOURS USE WITH A 24 HOUR PERIOD. IF RUN MORE THAN 10 HOURS IN A 24 HOUR PERIOD AN ADDITIONAL PRO-RATA CHARGE WILL BE MADE. ADDITIONAL RENTAL POLICIES: YOU MUST BE 18 OR OLDER, YOU MUST HAVE A VALID DL, YOU MUST PAY INITIALLY WITH A VALID CC - NO PREPAID CARDS ACCEPTED - THE PERSON RESPONSIBLE FOR THE EQUIPMENT MUST SIGN THE CONTRACT - RESERVATIONS MUST BE CANCELLED 24 HOURS IN ADVANCE - RENTAL TIME IS BASED ON TIME OUT - "NOT TIME USED" EXPLANATION OF DAMAGE WAIVER: THE DAMAGE WAIVER COVERS INCIDENTAL DAMAGES TO OUR EQUIPMENT. THE DAMAGE WAVER IS NOT AN INSURANCE POLICY. YOU WILL BE BILLED FOR A REPAIR FEE FOR ANY DAMAGES RESULTING FROM, BUT NOT LIMITED TO ABUSE, MISUSE OR OPERATOR ERROR. YOU MAY DECLINE THE DAMAGE WAIVER, BUT YOU WILL BE RESPONSIBLE FOR PROVIDING PROOF OF INSURANCE SHOWING A RENTAL RIDER PRIOR TO THE START OF A RENTAL. A CUSTOMER RENTS A SKID LOADER AND GETS IT STUCK IN A DITCH. THEY DECIDE TO PULL IT OUT WITH A CHAIN AND WRAP THE CHAIN AROUND THE BOOM ARMS. DURING THE PROCESS OF PULLING THE UNIT OUT THEY BEND THE BOOM ARMS OR DAMAGE THE CYLINDERS - THIS IS NOT COVERED BY THE DAMAGE WAIVER A CUSTOMER RENTS A SKID STEER LOADER AND HAS A LIMB SNAP BACK AND BREAK A HEADLIGHT - THIS IS COVERED BY THE DAMAGE WAIVER IF THE RENTAL UNIT ON THIS CONTRACT IS A LIFT, THEN A HARNESS HAS BEEN ADDED TO THIS CONTRACT BY THE LESSOR FOR PURCHASE BY THE CUSTOMER IF THE CUSTOMER DECLINES THE PURCHASE OF THIS HARNESS IT WILL BE RETURNED ON THE CONTRACT AND IT IS ASSUMED THAT THE CUSTOMER HAS ALL THE PROPER SAFETY EQUIPMENT NEEDED FOR THE PROPER AND SAFE LIFT OPERATION IF THE RENTAL UNIT ON THIS CONTRACT IS A LIFT, THEN THE CUSTOMER OR EMPLOYER ACKNOWLEDGES THAT ONLY QUALIFIED, TRAINED PERSONNEL WILL OPERATE THE LIFT RENTAL CONTRACT TERMS & CONDITIONS BY SIGNING THIS CONTRACT YOU AGREE TO THE TERMS & CONDITIONS STATED IN THIS SECTION.
